One major aspect of the Civil Rights Act of 1964 specifically provides protections against sex discrimination in the workplace: Title VII. According to this section of the act, it is illegal for an employer to fail to hire, discriminate against, terminate or refuse to hire any individual due to his or her sex. Terms of employment (such as compensation or benefits) cannot be based on sex, as this would constitute a violation of Title VII. Employees may also not be segregated, limited or classified by their sex or gender.

Though the terms “sex” and “gender” are often used interchangeably, there are marked differences for legal purposes. “Sex” refers an individual’s biological characteristics as male or female, while “gender” refers characteristics of an individual that are typically associated with males or females. Harassment or discrimination based upon either sex or gender is illegal and should not be tolerated.
